Please read these Terms & Conditions ("Terms") carefully before using our website, mobile application, or services (collectively, the "Platform"). By accessing or using the Platform you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Introduction

These Terms govern your use of our crypto trading, investment, and financial services, including AI trading tools, EA automation, Bitcoin cards, crypto-backed loans, wallets, investment plans, and related features (collectively, the "Services"). The Services are provided by flexifundfinance ("we", "us", or "our").

2. Acceptance of Terms

By signing up for an account, accessing, or using the Services you accept and agree to be bound by these Terms, our Privacy Policy, and any other policies or guidelines posted on the Platform. You must be at least the age of majority in your jurisdiction to use the Services.

3. Eligibility & Account Registration

To use the Services you must create an account and provide accurate, current, and complete registration information. You agree to keep your account information updated. We may require identity verification (KYC) and may limit or restrict Services if verification is not completed.

4. Account Security

You are responsible for maintaining the confidentiality of your account credentials, two-factor authentication (2FA), and any activity that occurs under your account. Notify us immediately if you suspect unauthorized access. We are not liable for losses due to compromised credentials where you were negligent.

5. Services Overview

We provide a variety of Services designed to help you trade, invest, spend, borrow against, and manage digital assets. These Services include but are not limited to:

  • AI-powered trading bots and automation engines
  • EA (Expert Advisor) support and integrations
  • Bitcoin payment cards and card management
  • Crypto-backed lending and borrowing facilities
  • Custodial and non-custodial wallet solutions
  • Investment plans, portfolio dashboards, and analytics

6. Use of AI & Automated Trading Tools

AI and automated trading tools analyze market data and execute strategies based on algorithms and user-selected parameters. These tools are provided for convenience and do not guarantee profits. You accept that automated trading and algorithmic strategies carry market risk and may result in losses. You remain fully responsible for any orders placed through your account, whether manual or automated.

7. Bitcoin Cards & Payments

Bitcoin cards allow conversion of cryptocurrency to fiat at the point of sale and are subject to issuer terms, local regulations, geographic availability, transaction limits, and fees. Activation, card issuance, and management are subject to additional terms and verification requirements. We do not guarantee acceptance by all merchants.

8. Crypto-Backed Loans

Crypto-backed loans require collateralization of approved crypto assets. Loan-to-value ratios, interest rates, repayment schedules, liquidation thresholds, and fees are defined in loan-specific agreements. Failure to maintain required collateral may result in partial or full liquidation of collateral. Loans are non-recourse only if explicitly stated in the loan agreement.

9. Fees, Charges & Billing

All Services may be subject to fees (trading fees, spread, subscription, card fees, loan interest, withdrawal fees, and other charges). Applicable fees are described on the Platform and are subject to change with notice. You are responsible for any taxes, duties, or levies associated with your use of the Services.

10. Risk Disclosure

Digital assets and cryptocurrencies are volatile, speculative, and can result in substantial or total loss. Past performance is not indicative of future results. By using the Services you acknowledge and accept the risks, including market, system, regulatory, and liquidity risks. Do not invest funds you cannot afford to lose.

11. Security & Custody

We implement industry-standard security measures including encryption, cold storage for custodial assets, monitoring, and secure infrastructure. Despite precautions, no system is completely secure. We are not liable for losses resulting from events outside our reasonable control, including but not limited to hacking, third-party breaches, or force majeure events.

12. Privacy & Data Usage

Our Privacy Policy governs the collection, use, and disclosure of personal and transaction data. By using the Services you consent to such data practices. Personal data may be used for verification, compliance, fraud prevention, customer service, and product improvement.

13. Intellectual Property

All content, trademarks, logos, software, and materials on the Platform are owned or licensed by us. You may not copy, modify, distribute, or create derivative works without our express written consent. Limited rights to use the Platform are granted subject to these Terms.

14. Prohibited Conduct

You must not use the Services for illegal activities, market manipulation, money laundering, terrorist financing, fraud, or any activity that violates applicable law or third-party rights. We reserve the right to suspend or terminate accounts engaged in prohibited conduct and to report unlawful activity to authorities.

15. Suspension, Termination & Account Restrictions

We may suspend or terminate accounts, restrict access, or refuse Services at our discretion for reasons including suspected fraud, non-compliance, or regulatory requirements. On termination, certain obligations survive, such as outstanding fees, ongoing loans, and dispute resolution clauses.

16. Disclaimers & Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICES.

17. Indemnification

You agree to indemnify and hold harmless flexifundfinance, its affiliates, officers, directors, employees, and agents against claims, losses, liabilities, damages, and expenses arising from your breach of these Terms, misuse of the Services, or violation of law or third-party rights.

18. Changes to Terms

We may modify these Terms from time to time. We will provide notice of material changes by posting updated Terms and, where required, by sending notice to your registered email. Continued use after changes constitutes acceptance of the updated Terms.

19. Governing Law & Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which flexifundfinance is incorporated, unless otherwise required by law. Disputes will be resolved through binding arbitration or in the courts specified in our arbitration clause, subject to local mandatory consumer protections.

20. Third-Party Services

The Platform may integrate third-party services (payment processors, card issuers, liquidity providers, analytics vendors). Your use of these services is subject to the third parties' terms and we are not responsible for their actions or omissions.

Notices may be provided via email, in-app messages, or posted on the Platform. It is your responsibility to maintain a valid email address and to review notices regularly.
